REPORT OF CONFERENCE COMMITTEE
MR. PRESIDENT AND MR. SPEAKER:
We, the undersigned conferees, have had under consideration the amendments to the following entitled BILL:
S.B. No. 2983: Air permit fees; revise method to calculate.
We, therefore, respectfully submit the following report and recommendation:
1. That the House recede from its Amendment No. 1, with the following exception:
2. That the Senate and House adopt the following amendment:
AMEND lines 141-144 by striking:
The fee assessed under this section shall not exceed Twenty-two Dollars ($22.00) per ton of emissions of each air pollutant for which fees can be assessed under the Title V program.
FURTHER, amend after line 192 by inserting the following subsection:
(6) The Chairman of the Advisory Council created under Section 49-17-16 shall submit an annual review of the air operating permit program and recommendations to the Chairman of the Senate Environmental Protection, Conservation and Water Resources Committee and the Chairman of the House Conservation and Water Resources Committee by January 1 of each year.
FURTHER, amend the title on line 3 by striking "SPECIFY THE MAXIMUM PER TON FEE AND" AND INSERTING "CLARIFY".
FURTHER, amend line 4 of the title after the semicolon by inserting "TO REQUIRE AN ANNUAL REPORT"
